Welcome to Treezy. These Terms & Conditions (“Terms”) govern your use of our services, including potted plant maintenance, lawn care, and plant rentals (collectively, the “Services”).
By using Treezy’s services or accessing our website, app, or communication platforms, you agree to these Terms.
1. Definitions & Interpretation
1.1 “Treezy / we / us / our” refers to Treezy (and its affiliated entities) providing the Services.
1.2 “Customer / you / your” refers to any individual, household, or entity requesting or receiving Services from Treezy.
1.3 “Service Request / Order” means any booking or request for Services made via Treezy’s platform or directly through communication channels.
1.4 “Service Provider / Green-Team” means Treezy’s assigned technician(s), gardener(s), or contractors performing the Services.
1.5 “Site / Premises” refers to the property, building, or outdoor area where the Services are carried out.
1.6 “Rental Period” means the duration for which plants are rented under Treezy’s rental service.
1.7 “Charges / Fees” means all payments due for Services rendered.
1.8 “Cancellation / Rescheduling” means modification or cancellation of a previously confirmed booking.
Interpretation: Headings are for convenience only. Singular includes plural. References to laws include any amendments or replacements.
2. Scope of Services
2.1 Potted Plant Maintenance
Treezy provides care and maintenance for indoor and outdoor potted plants, including watering, trimming, pest control, fertilization, soil improvement, and related horticultural practices.
2.2 Lawn Care
Treezy provides lawn mowing, weeding, aeration, edging, irrigation maintenance, seasonal care, and related turf management services.
2.3 Plant Rentals
Treezy offers plants and planters on rent for homes, offices, or events for a fixed Rental Period. Rentals may include regular maintenance visits, replacements, and pickup after the rental term ends.
2.4 Additional / Ad-hoc Works
Any additional landscaping or horticultural work outside the original Service scope will be separately quoted and billed.
3. Service Request, Confirmation & Scheduling
3.1 Bookings can be made via Treezy’s website, app, phone, or email.
3.2 A Service Request is confirmed once Treezy issues a booking confirmation with a date, scope, and estimated Charges.
3.3 Treezy may reschedule or refuse a request if site conditions are unsuitable, unsafe, or unavailable.
3.4 The Customer must ensure access, utilities (water, electricity), and safe working conditions for the Green-Team on the scheduled date.
3.5 Delays due to inaccessibility or customer unavailability may incur additional charges or be treated as cancellations.
4. Charges, Payment, and Billing
4.1 Quotation & Estimates
Quotes are based on the site visit, plant types, and service frequency.
4.2 Advance / Adhoc Payment
Treezy may request advance or adhoc payments for mobilization, especially for large-scale or rental projects.
4.3 Running Bills
For ongoing works or maintenance contracts, interim running bills may be raised. Final invoices will be issued upon completion or at billing intervals agreed upon.
4.4 Payment Modes
We accept digital transfers, credit/debit cards, UPI, wallets, or other approved payment methods. Cash may be accepted only upon prior confirmation.
4.5 Late / Non-Payment
Delayed payments may result in suspension of services, removal of rented plants, and/or late payment charges.
4.6 Price Revisions
Treezy reserves the right to revise prices periodically due to inflation, fuel costs, or input material changes, with prior notice to the Customer.
5. Cancellation, Rescheduling & Refunds
5.1 By Customer
Cancellations or rescheduling must be made at least 24 hours before the scheduled service.
Late cancellations may incur a service charge or partial payment deduction.
5.2 By Treezy
If Treezy must cancel due to unavailability, weather, or safety concerns, we will offer a reschedule or full refund.
5.3 Refunds
Approved refunds will be processed within 7–14 business days through the original payment mode.
6. Customer Obligations & Site Conditions
6.1 You must ensure you have ownership or legal permission to modify the landscape or install plants.
6.2 You must disclose site conditions including water access, drainage, existing utilities, or obstructions.
6.3 You must provide safe access, water, electricity, and a conducive environment for the work to be carried out.
6.4 Treezy will not be responsible for delays or damages caused by factors beyond our control.
6.5 Customers must not independently apply chemicals, pesticides, or soil additives without consulting Treezy.
6.6 The health and survival of plants depend on environmental factors beyond Treezy’s control. While services are performed with care, Treezy cannot guarantee 100% plant survival, uniform growth, or permanent lawn health.
6.7 If the Customer alters watering schedules, irrigation systems, lighting, or relocates plants, Treezy will not be responsible for resulting plant loss or damage.
7. Liability, Warranty & Indemnification
7.1 Limited Warranty
Treezy warrants that all services will be performed with reasonable skill, care, and professionalism. Except where explicitly stated, no other warranty (implied or express) applies.
7.2 Plant Mortality & Damage Disclaimer
Treezy is not liable for any plant, lawn, or tree casualties caused by:
- Natural causes, pests, disease, weather events, or seasonal change;
- Neglect, overwatering, or mismanagement by the Customer;
- Delays in access, irrigation failure, or external damage.
Treezy may, at its discretion, provide replacements or replanting at additional cost.
7.3 Rental Plant Responsibility
For rented plants, the Customer is liable for loss, theft, or major damage during the rental period. Replacement costs will be charged at market value or as per the rental contract.
7.4 Property Damage
Treezy is not responsible for damage to property, hardscape, or structures unless proven to result from clear negligence by Treezy personnel.
7.5 Limitation of Liability
Treezy’s total liability for any claim is limited to the total amount paid by the Customer for that specific service. Treezy is not responsible for indirect, incidental, or consequential losses.
7.6 Indemnification
You agree to indemnify Treezy against all losses, damages, or legal costs arising from misuse of services, breach of Terms, or failure to disclose site risks.
7.7 Force Majeure
Treezy shall not be liable for failure to perform obligations due to events beyond its control, including extreme weather, strikes, supply shortages, or pandemics.
8. Intellectual Property
All content on Treezy’s website/app (logos, designs, service descriptions, images) is owned by Treezy and protected under copyright and trademark law.
You may not reproduce, copy, or use Treezy’s branding without written consent.
9. Privacy & Data Protection
Treezy collects and processes personal information (name, contact, address, payment data) solely for service delivery and communication.
Your data is handled as per our Privacy Policy and applicable data protection laws.
You consent to receive service reminders, billing updates, and promotional communications unless you opt out.
10. Dispute Resolution & Governing Law
10.1 These Terms shall be governed by the laws of India, with exclusive jurisdiction of the courts at New Delhi.
10.2 Both parties will attempt to resolve disputes amicably before legal escalation.
10.3 Any claims must be raised within 12 months from the cause of action, failing which they will be deemed waived.
11. Amendments
Treezy may update these Terms periodically. Updated versions will be published on our website with a “last updated” date. Continued use of our Services implies acceptance of the revised Terms.
